ONE DAY STRIKE ON 15TH FEBRUARY 2017
·       AGAINST THE BREACH OF ASSURANCE AND BETRAYAL BY GROUP OF MINISTERS OF NDA GOVERNMENT.
·      TO UPHOLD THE SELF-RESPECT AND DIGNITY OF 33 LAKHS CENTRAL GOVERNMENT EMPLOYEES AND 34 LAKHS PENSIONERS.
ABOUT 15 LAKHS CENTRAL GOVERNMENT EMPLOYEES AND AUTONOMOUS BODY EMPLOYEES WILL PARTICIPATE IN THE STRIKE
v  Central Government employees and Pensioners betrayed by NDA Govt. by breach of assurance given by Group of Cabinet Ministers including Shri Rajnath Singh, Shiri Arun Jaitely and Shri Suresh Prabhu regarding increase in Minimum Pay and Fitment formula. This is the worst pay revision after 2nd CPC report in 1960. Government implemented the report without any modification suggested by Staff side (JCM). In 1960 entire employees went on five days strike.
v  Central Government Pensioners and Family Pensioners betrayed by NDA Government by not implementing Option-I (parity) recommended by 7th CPC and accepted by Cabinet.
v  Autonomous bodies employees betrayed by NDA Government by issuing instructions NOT TO IMPLEMENT 7th CPC benefits to Autonomous body employees and Pensioners UNTIL FURTHER ORDERS.
v  Three lakhs Gramin Dak Sevaks of the Postal Department betrayed by NDA Government by not extending the benefits of 7th CPC to them and also by not publishing the separate one-man committee report already submitted to the Government.
v  Thousands of Casual, Part-time, contingent employees, daily rated mazdoors and contract workers are betrayed by the NDA Government by not regularizing their services and by not revising their wages on the principle of “Equal Pay for Equal Work”.
v  7th CPC Submitted its report after 21 months on 19th November 2015. Even after 13 months the NDA Government has not implemented the revised HRA, Transport Allowance and all other Allowances. Government is deliberately delaying it further to deny implementation from 01.01.2016 and also to delay it to next Financial year 2017, thereby denying arrears.
v  Government betrayed Central Government employees and Pensioners by denying eligible 3% Dearness Allownace with effect from 01.07.2016. DA for pre-revised Minimum pay of 7000 is 7% = 490 per month. Same pre-revised pay of 7000 revised to 18000 after merger of 125% DA as on 01.01.2016. New DA granted for revised minimum pay of 18000 is 2% = 360 per month. Thus there is a recurring loss of Rs. 130/- per month in DA granted to Minimum pay. For other higher pay scales the loss is still higher.
v  In the past, only one Committee before implementation of CPC report and one Anomaly Committed after implementation was constituted. This time Committee after Committees are constituted but no negotiated settlement with the JCM (NC) staff side on any of the issue, but only one-way hearing of the views of the staff side. Implementation Committee, Empowered Committee, Allowances Committee, Pension (Option-1) Committee, Anomaly Committee, New Pension System (NPS) Committee and Senior officers Committee (?) to discuss the issues arising out of 7th CPC recommendations. (no formal orders constituting the Group of Senior Offices Committee and no terms of reference made public). Almost six months are over after Cabinet approving pay scales and one year is over after submission of 7th CPC report, but no outcome of any committee).
v  No negotiated settlement on Confederation’s 21 Point Charter of demands which includes increase in minimum pay, Fitment formula, no reduction of HRA rate, Revision of all allownaces, Restoration of abolished Advances, Option-1 for pensioners, Scrap New Pension System, Autonomous bodies wage revision, GDS Issues, Casual Labour issues, MACP promotional hierarchy and “Very good” bench mark, filling up of vacancies, removal of 5% compassionate appointment restriction, Five promotions, LDC/UDC pay upgradation, Parity in pay scales with Central Secretariat Staff, removal of CCL adverse condition, equal pay for equal work etc.
WHAT HAPPENED ON 30TH JUNE 2016 ?
AND WHO BETRAYED THE EMPLOYEES AND PENSIONERS ?
On the night of 30th June 2016, Shri Suresh Prabhu, Hon’ble Minister for Railways informed the Secretary, JCM (NC) Staff side Shri Shiv Gopal Misra that the Prime Minister had empowered three Cabinet Ministers, viz: Shri Rajnath Singh, Hon’ble Home Minister, Shri Arun Jaitely, Hon’ble Fiance Minister and Shri Suresh Prabhakar Prabhu, Hon’ble Railways Minister, to negotiate with the staff side, JCM (NC), and invited staff side (JCM) for a meeting at the Official residence of Shri Rajnath Singh, Hon’ble Home Minister on the same night 21:30 hrs. On persistent demand of the staff side (JCM), the Group of Ministers assured that the issue of increase in the Minimum wage and Fitment formula will be referred to a High Level Committee and the Committee will submit its report to the Government within four months.
NOW SIX MONTH’S ARE ALMOST OVER.

Let us make the 15th February 2017 one day strike a resounding success.

15th FEBRUARY 2017 – ONE DAY STRIKE

Towards the inevitable end - Victory.

December-January is fog days in Northern India, especially Delhi.  Because of the high level pollution, it is not fog that engulfs Delhi but smog.  Temperature dips and rises quite often.  Air and Rail traffics are frequently disturbed and sometimes go out of gear.  It was not unknown to the National Sectt.of the Confederation when they decided to organize the rally at the Parliament street on 15th December, 2016. There was no alternative as on November, 6th, the stipulated four months period was over.   The National Sectt. of the Confederation came to the conclusion that the Government of India is run by people who indulges in double speak.  They have no shame even in indulging in betrayal.    

Confederation has a noble history and fine tradition. It does not indulge in the nasty habit of mincing words.  It exhibits the courage of calling a spade a spade.  It always has stood for the interest of the employees and workers, whom it represents.  It was built up over the years in the high values and traditions of a fine trade union.  While it believes that despite the differences in ideology, perception, and approach to the issues and problems, methods of negotiation, unity of the employees and workers are paramount in winning demands.   It was to uphold that tradition, on innumerable occasions, it agreed to defer the strike action, and ultimately even on 11th July, 2016.  It had perceived correctly the weak pretensions of the Government, demonstrated before the leaders of the NJCA both on 30th june, 2016 and 6th July, 2016.  Therefore, its leadership could appreciate  the criticism that emanated from the right thinking persons in its stride. Many of those who chose to criticize the decision were concerned of the dent  the decision to defer the strike action  had created to the image of the Confederation.  An explanatory campaign was the need of the hour.  For sheer paucity of time, it could not be undertaken.  It would have allayed the apprehensions.  When it was done, though a little belatedly, it had its salutary impact.  And naturally, the National Sectt. could not have indulged in the luxury of revisiting the issue with independent action programme  when the climate in Delhi could become tolerable.  As is the case with every vibrant organization, there are persons who take advantage of the situation, criticize and create cacophony with the intent of destroying the very organization itself. The mammoth rally at Delhi in front of  the Parliament house on 15th December, 2016 was the vindication of the understanding the Confederation National Sectt. had on the issues and a magnificent reply to all those whose intent was to destroy the organization.  

It is quite heartening that our Comrades, who felt betrayed by the chicanery of the Present Government, weathered the inclement weather conditions, the disruption of rail and air traffic movements,  the difficulties in reaching the venue by road, the chilly atmosphere at Delhi and above all the persisting engineered criticism of certain vested interest,  exhibited the anger and discontent in the most exemplary manner on 15th December, 2016.  They deserve our felicitation, congratulation and grateful salute in creating yet another historic and successful programme.  They have through their loud and emphatic slogans raised and followed by thousands provided the required impetus to the National Sect. and confidence to go ahead with the forward steps of the battle.  The decision that was announced by the Secretary General to organize a one day token strike in protest against the attitude of the BJP Government was greeted therefore, with great enthusiasm by the rallyists

The demonetization and the consequent debilitating impact over the availability of currency has indeed made insurmountable impediments.  The whole country has been taken for a ride in the name of the noble cause of cleaning the economy of the black income.  Neither the generation of the black income  s tapped nor its proliferation  has been  targeted.  About one fifth of the National income of the country is stated to be in black. That hurts and hurts the common people.  While the successive Governments that came to power in the country since 1991, including the present in office had been extending concessions and exemptions for the corporate giants in crores, the common people were finding it difficult to make the both ends meet. The enforcement laws fear to knock at the doors of  those who have looted the  Nation and refused to pay back even  the loan they had contracted from the Nationalized Banks . The circus in the floor of the Parliament, session after session,  precludes any serious discussion or deliberation over the good  or bad of the executive  decisions concerning governance.   All appears to be with a  design to obliterate the real issues of the people from the centre stage.

The 105,000- crores, which is a highly exaggerated financial outflow worked out by the 7th CPC for this fiscal year has been substantially reduced, thanks to the deferring the grant of enhanced allowances, disapproval of the Option No.1 granted by the commission to the Pensioners as a relief, the continuous derailing of the negotiating machinery and the sheer refusal even to abide by the decisions of the Judiciary and Arbitration Boards, deferring decision on extending the benefit of revision of wages and pension  to the employees of the autonomous organizations  etc. To sustain the untenable actions, threats are employed invoking the provisions of the colonial rules and regulations.   A good number of participants in the magnificent rally at the Parliament street on 15th December, 2016 was the retired personnel, despite their physical debilities due to the advancing age.  They look forward to the NCCPA and the Confederation to articulate, present and fight for their demands and ensure that justice is rendered to them.


There is no doubt that the ongoing struggle undertaken by the Confederation will create sanctions not only on the Government but also on those who witness it from the sidelines but refuse to become part and parcel of an event that is bound to have its imprint in the history of the movement of the Central Government employees in the country. That should not deter us but steel  our determination to march to its glorious end of victory.

THE STRIKE BECOMES INEVITABLE

                It is now more than four months that the Government has held out the assurance to the leaders of NJCA that they would revisit the minimum wage determination and the consequent fitment factor of the 7th CPC.  The understanding reached on 30th June, 2016 was that the Government would set up a high level committee to examine the complaint made by the employees organizations to the effect that the 7th CPC had not adhered to the norms of the Dr. Aykhroyd formula.  The said decision was in the backdrop of the NJCA’s strike notice which was served on 9th June, 2016 and its resolve to go ahead with the said decision to organize the indefinite strike action from 11th July, 2016. 
            The employees had realized that contrary to the impression, the 7th CPC  imparted to the leaders during their interaction with it, its final suggestions were extremely nugatory and were the product  of pressure exerted by the Government on the Commission .at the fag end of its functioning.  They found that the minimum wage determined by the commission was in violation with the agreed principles of wage determination in the case of civil servants, it had recommended the least quantum increase in the wages in comparison with all the earlier Commissions; it had reduced the rates of various allowances without any valid  rhyme or reason; it had abolished certain allowances despite the continuance of the extra functions/circumstances for which those allowances were originally granted; had abolished all interest free advances;  had withdrawn the existing benefits, perks and privileges which had originally granted to a section of the employees and officers taking into account the peculiarities of the assigned jobs to them etc.  Naturally the disappointment that arose from such negative attitude of the Commission paved way for anger and consequent agitation,  creating thus an atmosphere of confrontation. 
            The setting-up of a committee under the Chairmanship of the Cabinet Secretary was, therefore, seen as a step in the right direction.  After about six months deliberations, the Committee seems to have given a report to the Government content of which was not made public.  However, during its inter action with the Staff Side, the Committee had given the impression and indication  that it would make changes to the quantum of minimum wage and fitment factor and the Fixed Medical Allowance of the Pensioners would be suitably amended.  The Committee intimated the staff Side that the Government would set up separate Committees for allowances and advances to effect a relook into the matter in consultation with various nodal departments of the Government of India.  In other words, the Government through the Committee headed by the Cabinet Secretary conveyed that it would create a conducive climate for a fruitful negotiation and settlement. 
            The 29th June proclamation in the form of Notifications was a bolt from the blue .   Was it designed to discredit the NJCA leadership or snub the Committee headed by the Cabinet Secretary or reflection of the arrogance of the party in power was not discernible.  It was in that background the NJCA met on 30th June and decided unanimously to go ahead with the preparation for the indefinite strike action.  Undoubtedly the  Government’s attitude had added fuel to the fire of anger and the leaders especially at the gross root level ,who had hoped that the Government would avert the situation of confrontation welcomed the decision of the NJCA wholeheartedly.
            The late night discussions, the group of Ministers  had with the NJCA leadership on 30th June, 2016  and the offer of a negotiated settlement of the core issues through the setting up of a high level committee was considered a step in the right direction by the NJCA leadership while accepting the offer of talks, though the State level leadership in quite a number of states felt that the Government was indulging in chicanery.  
            
The time frame of six months for the Committee to complete its deliberations and make suggestions to the government on the core issues was over technically on 6th November, 2016 .  The  National Secretariat  of the Confederation met and rightly decided to chalk out a series of programmes of action, the second phase of which would be carried out on 15th June, 2016 in the form of a massive march to the Parliament house. These programmes are to culminate in a strike action.   Isolated action, the Confederation is fully aware is not capable of bringing about compulsion on the Government to revise their decisions promulgated on 29th June, 2016.   Confederation is confident that the Defence and Railway organizations who are the predominant partners in the NJCA  would realize the gravity of the situation  and enliven the NJCA  and spearhead the movement to its logical end.  Isolated ventures will not be avoidable  in certain exigencies, when demarcation in action becomes necessary so as to maintain the character and ideology of the organization and confidence of its members becomes paramount.

Meeting With Chairman CBDT on 26.11.2016
The Chairman CBDT invited the Central JCA for a meeting on the basis of our notice dated 17th November, 2016 for agitation in front of all Principal Chief Commissioner’s offices and office of the Pr.DGIT(HRD) on 25.11.2016. Accordingly a meeting took place on 26.11.2016 at 4.00 P.M at Chairman’s Chamber, North Block New Delhi.
            The Chairman formally welcomed all the members of JCA, Member (P), DG(HRD) and officials of CBDT and appraised about his busy schedule regarding policy taken by the Govt. on demonetisation Issue. The leadership also express the concern of all members regarding long pending issues.
The following issues were discussed.
1.      Laptop to ITI
2.      Pending Recruitment Rules
3.      All regular and Ad-hoc promotion which is due at the level of Pr. CCsIT (CCA)
4.      Ad-hoc Promotion for 2016-17 ITO to ACIT and regularisation od 2014-15
5.      Ad-hoc promotion to the post of Principal A.O
6.      GRANT OF Laptop computers to officers and Inspectors.
7.      Fill Up all Vacancies :-
(i)   Restoration of Zonal/Regional Recruitment
(ii)  Recruitment of MTS by special Recruitment Drive or recruitment through Employment Exchange immediately.
8.      Cadre Restructuring and related matters:
(i)      The ban on promotion of posts to be phased out from WB.
(ii)     Phasing out of 1633 posts from WB.
(iii)   Diversion of 167 posts of ITI
9.      Regularisation/Payment of arrears after giving effect from 1.1.2006 as per 6th CPC to Casual workers.
10.  Filling up of posts in Departmental Canteen.
11.  N R Parmar Issue
12.  Compassionate appointment

For all the above issues the chairman directed the CBDT officials to look into immediately and assured that the steps taken in a time bound manner and a status report will be given before 15th December 2016.The meeting was cordial and Chairman heard all our grievances and assured to intervene, wherever necessary with concern Principal CCsIT to settle the local issues.
After discussion with available comrades, we decided to postpone our agitation program up to 15.12.2016 and it will be discussed again in the next Secretariat Meeting which is scheduled to be held on 15.12.2016.

Subject:- Timely and advance action in convening of Departmental Promotion Committee meeting in terms of Model Calendar-regarding.


The undersigned is directed to state that with a view to having the approved select panels for promotion ready in advance in a time-bound manner, this Department has issued a Model Calendar for DPCs vide OM No. 22011/9/98-Estt. (D) dated 8th September, 1998 as modified vide OM No. 22011/4/2013-Estt.(D) dated 28.01.2015. An indicative pattern has been provided in the Model Calendar for various events involved in the pre/ post DPC related actions. All the Ministries/Departments have been impressed upon from time to time by this Department to adhere to the prescribed time-line so as to ensure that the panel is ready in time and is utilised as and when the vacancies arise during the course of the vacancy year.
2. It has been brought to the notice that many promotion posts are lying vacant due to abnormal delay in convening DPCs. The objective of timely promotions of employees m various Ministries/Departments can be achieved only by holding DPC meetings.
3. In view of above, all Ministries/Departments are again advised to ensure strict compliance of instructions in order to achieve the desired objectives of timely convening of DPCs/preparation of approved select panels within the prescribed time frame.

Subject: Review of Model Calendar for the Departmental Promotion Committees (DPCs) being conducted by the Ministries / Departments.
Reference is drawn to this Department’s instructions on Model calendar for DPCs vide O.M. No.22011/9/98-Estt (D) dated 8th September, 1998. The Model Calendar envisages initiating action in advance of the commencement of the vacancy year so as to have the approved select panels ready before start of the vacancy year and ensure timely promotions of employees.
2. The Annual Performance Assessment Reports (APAR) schedule separately provide a time schedule for preparation/completion of APARs O.M. No.21011/1/2005-Estt.(A) (Pt.II) dated 23rd July, 2009. The crucial date of eligibility is 1st April of the vacancy year (Financial year based vacancy year) and 1st January (Calendar year based vacancy year) as per O.M. No.22011/6/2013-Estt(D) dated 28th May, 2014.
3. The schedule of Model Calendar for conduct of DPCs in line with the time schedule for completion of APARs so that the panel as approved by the Competent Authority is available before the commencement of the vacancy year has been further examined. It has been decided to reschedule the time frame for the DPCs being conducted by Ministries/Departments themselves as below:-

MAKE THE 7TH NOVEMBER 2016 MASS DHARNA PROGRAMME A GRAND SUCCESS

1st phase of the agitational programmes was conducted successfully on 20.10.2016 as per the call given by the Confederation of Central govt. employees & Workers. The next phase of programme is Mass Dharna on 7th November 2016. All are requested to join and make the programme a grand success.

2nd Meetings of the Group of Senior Officers (Constituted as per the assurance given by Group of Minister to NJCA) to discuss the grievances arising out of recommendations related to 7th Central Pay Commission, was held with JCM (NC) staff side on 24.10.2016 at 4 PM. The staff side explained in detail the justification for modification in the minimum pay and fitment formula, which was already explained in the memorandum submitted to Cabinet Secretary on 10th December 2015 and also in the presentation made before Joint Secretary Implementation Cell and Empowered Committee of Secretaries headed by Cabinet Secretary.

From the response of the Senior Officers, it is not clear whether they are mandated to submit a proposal on increasing the Minimum Pay and Fitment formula to Government, as assured by the Group of Ministers on 30th June 2016. Eventhough, the time frame of four months is almost over, the urgency and seriousness was lacking on the part of the Group of officers. It seems that that Government is adopting a delaying tactics or to deny the assured increase. Perhaps, they may recommend an increase in minimum pay and fitment formula at a later date, but it is quite uncertain.

Confederation National Secretariat after reviewing these developments has decided to intensify the campaign and agitational programmes demanding the Government to honour its assurance given to NJCA leadership and also to settle the 20 point charter of demands.
 
 Make the 7th November 2016 mass dharna programme a grand success. Ensure maximum participation of employees in the 15th December 2016 massive Parliament March. Get ready for strike.

GIST OF THE JCM STANDING COMMITTEE MEETING HELD ON 25.11.2016

Meeting was held under the chairmanship of Secretary, Department of Personnel. Items discussed and outcome is given below.

1.        JCM FUNCTIONING

Decision: After discussion Secretary (P), assured that the JCM would be activated and steps may be taken to hold regular meetings of JCM at National and Departmental level.

2.        COMPASSIONATE APPOINTMENT:

Decision: The demand of the staff side to remove 5% ceiling would be considered after studying the various. Supreme Court Judgments and the decisions of previous National Council JCM meetings.

3.        RESTORATION OF INTEREST FREE ADVANCES WITHDRAWN BY THE GOVERNMENT BASED ON 7TH CPC RECOMMENDATIONS

DecisionThe demand of the staff side to restore Festival advance, Natural Calamity advance and leave salary advance will be examined further.

4.        AMENDMENT TO THE DEFINITION OF THE TERM “ANOMALY”

Decision: The proposal given by the staff side would be considered is consultation with Department of Expenditure.

5.        FIXATION OF PAY OF RE-EMPLOYED EX-SERVICEMEN

Decision: - The anomalies in the fixation of pay of re-employed Ex-Servicemen is under consideration of DOP&T.

6.  OPTION FOR THOSE TO BE PROMOTED AFTER 25.07.2016, I.E. AFTER THE NOTIFICATION OF CS (REVISED PAY) RULES 2016.

Decision: - This issue would be considered by the Implementation Cell of 7th CPC.

7.        WITHDRAWL OF NEW CONDITIONS FOR THE GRANT OF MACP & GRANT OF MACP ON PROMOTIONAL HIERARCHY

Decision: The demand of the Staff Side for withdrawal of “Very Good” grading would be re-examined. Regarding justification of MACP on Promotional hierarchy all the points submitted alongwith the Note on agenda items by staff side was discussed in detail. The official side agreed to examine issue further based on the points raised by the staff side.

8.       BONUS CEILING TO BE RAISED TO 7000 FOR GRAMIN DAK SEVAK EMPLOYEES OF POSTAL DEPARTMENT

Decision: - Revision of Bonus ceiling for GDS and Casual Labourers would be considered by Department of Expenditure.

9.        REGULARISATION OF CASUAL LABOURERS

Decision: The proposal of the staff side for regularization of all casual labourers would be considered after considering various Supreme Court judgements.

10.     FILLING UP OF EXISTING VACANT POSTS
Decision:  – Since there is no ban on recruitment, vacancies can be filled up. Instructions in this regard will be issued once again.

11.     UPGRADATION OF THE POSTS OF LOWER DIVISION CLERKS TO UPPER DIVISION CLERKS

Decision: The demand of the staff side would be considered in consultation with other Ministries.

12.   GRANT OF ONE TIME RELAXATION TO THE CENTRAL GOVERNMENT EMPLOYEES WHO HAVE AVAILED LTC-80 AND TRAVELLED BY AIR BY PURCHASING TICKETS FROM OTHER THAN AUTHORIZED AGENCIES

Decision: - The proposal of Ministry of Defence in this regard is under examination of DOP&T

13.     GRANT OF ENTRY PAY RECOMMENDED BY 6TH CPC TO THE PROMOTEES UNDER THE PROVISION OF CCS (RP) RULES 2008.

Decision: -    The Judgment of Chennai CAT and Principal Bench New Delhi would be examined by DOP&T and Department of Expenditure.

14. REIMBURSEMENT OF ACTUAL MEDICAL EXPENDITURE INCURRED BY THE EMPLOYEES IN A RECOGNIZED HOSPITAL.
