Subject: - TDS deduction under section 194A of the Income-tax Act, 1961 in case of Senior Citizens - reg.-
It has been brought to the notice of CBDT that in case of Senior Citizens, some TDS deductors/Banks are making TDS deductions even when the amount of income does not exceed fifty thousand rupees. The same is not in accordance with the law as the Income-tax Act provides that no tax deduction at source under section 194A shall be made in the case of Senior Citizens where the amount of such income or, the aggregate of the amounts of such income credited or paid during the financial year does not exceed fifty thousand rupees. (Please refer to the third proviso to sub-section 3 of section 194A)

2. Under sub-rule (5) of Rule 31A of the Income-tax Rules, 1962, the Director General of Income-tax (Systems) is authorized to specify the procedures, formats and standards for the purposes of furnishing and verification of the statements or claim for refund in Form 26B and shall be responsible for the day-to-day administration in relation to furnishing and verification of the statements or claim for refund in Form 26B in the manner so specified.

3. In exercise of the powers delegated by the Central Board of Direct Taxes (Board) under sub-rule (5) of Rule 31A of the Income-tax Rules, 1962, the Principal Director General of Income-tax (Systems) hereby clarifies that no tax deduction at source under section 194A shall be made in the case of Senior Citizens where the amount of such income or, the aggregate of the amounts of such income credited or paid during the financial year does not exceed fifty thousand rupees.

JCA to boycott search & survey operatiosns

       Dear Comrade,

Sub :-      Revival of the agitation since suspended in support of important pending demands - matter regarding -

As decided in the Central JCA meeting, a communication had earlier been sent on 31st July 2018 to the Chairman, CBDT conveying that the suspension of the above stated agitation programme would continue till 18th August .2018, purely on the basis of the assurances received from him as well as from the then Member(Admn), CBDT. The Central JCA thereafter pursued the issues with the concerned authorities on regular basis and met the newly appointed Member (Admn.) on almost every alternate working day. The assurances given by the concerned authorities as well as the Member (Admn.), CBDT during the day to day persuasion were discussed in the Central JCA and the suspension of agitation was extended accordingly beyond the date communicated to the Board, expecting the positive outcome. The developments were also duly communicatedto the JCA members.

But we have dismayed to observe that even the direction and the assurances from the highest level of the CBDT have failed to yield any fruitful result in case of almost all of the pending issues of the charter of demands. Whatever little progress taken place has been clearly detrimental to the interest of our members.

In such a scenario, the Central JCA cannot remain mute spectator and allow the authority to take the restraint exercised or cooperation extended by us as granted. The Central JCA earlier authorized its joint convenors to review the situation from time to time and take appropriate call considering all aspects. Accordingly, progress made so far against each of the demands and the prevailing position have been reviewed. Some other issues of primary importance emerged later have also been considered. 




After the careful consideration, it is decided that the suspended agitation programme is required to be revived and as a first move, the members of Central JCA will not participate any Survey including TDS Survey/Spot Verification and Search & Seizure operation from 1st December 2018, unless the following pending issues are resolved immediately:

1)     Constitution of the Cadre Review Committee.

2)     Recruitment Rules of EA and ITI may be put on hold till the next Cadre Review as per discussion held with the then Member(Admin), CBDT with the JCA.

3)     Relaxation for promotion to the posts of TA/Sr.TA/Steno Gr.II (erstwhile) in existing RR due to huge vacancies in promotion quota and change of crucial date of eligibility from 1st April to 1st January as Per DoPT’s Order.

4)     Regularisation of 2014-15 batch of promote ad-hoc ACIT and their timely promotion DCIT w.e.f 01.01.2019 including the left over officers of 2013 and earlier batches.

5)     Grant pay parity of Inspector & ITO with the IB/CBI and upgradation of pay of Tax Assistant to Rs.2800 as per CSS/Organized Accounts Service through Departmental Anomaly Committee.

It is therefore appealed to all JCA members to participate in the revived agitation programme to make it successful in such a manner that the authority shall be compelled to take note and resolve the issues at the earliest. The decision of revival of the agitation has already been communicated to the Chairman. CBDT and the Member (Admn.), CBDT.
All jointconvenors ofstate JCA are requested to submit a copy of letter addressed to the Chairman CBDT to the respective Pr. CCsIT/DGsIT(Inv) for information and necessary action. A campaign programme is also requiredamongst the members particularly posted in Investigation/Assessment charges. Kindly do the needful for successfully implementation of the above mentioned programme.

 INCOME TAX EMPLOYEES FEDERATION, MUMBAI CIRCLE

Dear Comrades,

We have been pursuing various issues of concern to our members including promotions with the administration. Inspite of the stand of the Admn. that no promotion orders can be issued in any of the cadres in the light of the CAT order on implementing the Hon’ble Supreme Court decision in the case of M. Nagraj, we have been successful in ensuring that promotions orders are issued in all the cadres except ITO. Since the CAT decision is directly related to the ITO promotions and consequent developments at various stages including the latest decision of Hon’ble Supreme Court on the issue, the promotion was delayed. Even though we are of the considered opinion that nothing stops the admn. from giving ad-hoc promotions, the admn. has been dithering on the issue citing the contempt petition filed by some of the litigants.  When we met the Pr.CCIT it was assured that after taking opinion of ASG, the promotion will be issued shortly. However, it is nearly one month since the assurances were given but without any progress giving the impression that the admn. is simply buying time for reasons best known to them. In the circumstances we are left with no alternative but to embark upon agitational path on this issue.
Another important issue that is engaging our attention is the condition of the BKC office building where our members are working in constant threat to their life. Portions of the structrure are falling down frequently, endangering the lives of employees and officers. The admn. had claimed that funds have been given to CPWD and repair work is being carried out. However, no concrete improvement is visible. In the circumstances, the Federation cannot sit quite and allow a tragedy to happen. Hence, it has been decided to go on agitation  in BKC to demand shifting of the offices to the New BKC office building which is now ready to occupy. On every issue the Pr.CCIT wants us to find the solution making us to wonder as to who is the Pr.CCIT in Mumbai!

Along with the above two issues the following issues concerning our members are also awaiting for immediate action of the Income Tax administration in Mumbai:

1.            Promotion to the post of ITO &  Inspector.
2.         Disparity in vacancies in the cadre of TAs and Inspectors cadre for promotion.
3.      Space allotment for staff at new office project at BKC and immediate action on our letter dated     05.06.2017.
4.         Funds for Medical Reimbursement and Conveyance.
5.         Allotment of Office space for Income Tax Pensioners Association.
6.         Staff Quarters:            a)  Appointment  of caeretakers
                                                b)  Belapur –  Renovation and Roofing over the top.
                                                c)  Bhandup/Antop Hill – Renovation wherever required.
7.         MACP restoration in the case of OS/Steno Gr.I after clarification and reimbursement of the          recovery made.
8.         Bunching in the light of the DOPT order consequent to 7th CPC recommendations.
9.         Bus service from Bandra and Kurla station to BKC offices.
10.    Desktop computers to all employees for implementation of ITBA/HRMS/PFMS with mandatory        training to all.
11.       No outsourcing of departmental functions.
12.       Canteen Recruitment.
13.       Newly acquired office space at Vashi acquired from MTNL: ITEF may be taken in tom Confidence             while making necessary seating arrangement etc.
14.       Briefcase /office bag reimbursement may be extended to Sr.TA and OS also as similarly placed   officials in the Gr. Pay of Rs.4200/-are entitled to brief case reimbursement in other places.
15.       The Security of Income Tax department has been handed over to a new agency at a huge cost.    Earlier, as demanded by us only Ex-servicemen used to be deployed and they were doing a better             job. The performances of the new security guards are worse and a large amount of public             money is being wasted as the cost involved is much higher.                                                                                                                          
                        The Federation along with ITGOA, Mumbai has decided to embark on the following agitational programme in pursuance of the above demands:
  1)  15.10.2018      -           Mass demonstration and Walk-out at BKC
 2) 16.10.2018      -     Lunch-hour demonstration in front of Aayakar Bhavan and                                                                      Mass deputation to the Pr.CCIT.  Members of ITEF from BKC                                                                 will also be joining the protest.
  3)    17.10.2018      -            Half-day Walkout in all Income Tax Offices in Mumbai.
 4)    22.10.2018  -               Sustained agaitational programme the details
              onwards                    of which will be intimated in due course.

We call upon all our members to kindly ensure that all the agitational programmes are carried out in its totality which alone will bring about a solution to our issues. Further programmes of action, in case the issues are not sorted out by 22.10.2018, will be informed to you in due course. We are sure as in the past each and every one of you will stand united in the fight against injustice and discrimination being meted out to our members and have no doubt in your minds Comrades, the ultimate victory shall be ours!.

DECISION OF THE NATIONAL SECRETARIAT MEETING HELD ON 05.09.2018 AT NEW DELHI

Dear Comrades,

National Secretariat meeting of Confederation with available Secretariat Members was held on 05.09.2018 at NFPE Head Quarters, New Delhi.

1.      5TH SEPTEMBER 2018 – MASS RALLY AT NEW DELHI – REVIEW
The rally was well organized and a grand success. About 5000 Central Government employees from all states, representing various affiliates and C-O-Cs of Confederation had participated in the rally. The rally of Confederation was very good, impressive and clourful. Participants wearing caps and T-Shirts with “SCRAP NPS” demand written on it and holding about 500 placards with “SCRAP NPS, SETTLE CHARTER OF DEMANDS” slogan along with flags and banners of affiliates and C-O-Cs made the rally most attractive and inspiring. With the participation of thousands and thousands of workers and peasants of Trade Union and Class and mass organisations the entire Jantar Mantar and Parliament Street became an ocean of red with about 2 to 3 lakhs participants. The rally demanded the NDA Government to stop the anti-worker, anti-people neo-liberal economic policies and also the divisive policy of communalism. The message of the rally was loud and clear. If the Modi Govt. is not ready to change the retrograde policies, the workers and peasants shall intensify their campaign to change the Government.

2.      15TH NOVEMBER 2018 – NATIONWIDE ONE DAY STRIKE OF CENTRAL GOVERNMENT EMPLOYEES
It is decided to further intensify the campaign programme to make the 15th November 2018 one day strike a resounding success. The 10 points Charter of demands of Confederation, especially the “SCRAP NPS & HONOUR ASSURANCE” demands should be popularised among all section of employees and pensioners. The National Secretariat Members of Confederation shall attend one largely attended, well organized campaign programme in each state. Campaign programme of National Secretariat Members will be finalized and published shortly in consultation with all Natinal Secretariat Members. In addition to the campaign of National Secretariat Members, each affiliated organization and C-O-C shall organize its own separate campaign programme among its own membership in maximum places.

Tour programme of National Secretariat members will be from 3rd October to 3rd November 2018, as already decided in the Hyderabad National Convention.

3.      28.09.2018 – NATIONAL CONVENTION OF WORKERS
A National Convention of workers will be organized by all Central Trade Unions (except BMS) and independent Federations (including Confederation) on 28th September 2018 at Mavalankar Hall, New Delhi from 10 AM onwards, to discuss and decide about next course of united country wide actions including strike against the anti-worker, anti-people policies of the NDA Government. If the Convention declare strike, then the date of the 15th November strike of Confederation will be changed to synchronise with the strike date of Central Trade Unions and independent Federations, as already decided in the Hyderabad National Covention.

4.      NJCA Programme – OBSERVE “ALL INDIA DEMANDS DAY” ON 19.09.2018.
It is decided that all affiliates of Confederation and C-O-Cs shall implement the “All India Demands Day” call of the NJCA on 19.09.2018, by holding protest demonstrations at all Centres and also in front of all Central Government offices.

The main demands raised by NJCA are –
            (1)   Scrap Contributory Pension System
            (2)   Enhance Minimum Pay and Fitment Formula.
            (3)   Implement Option-I also as pension fixation formula

Whether NJCA will revive the indefinite strike or not depends upon the decision of Railway Federation (AIRF & NFIR). Confederation and All India Defence Employees Federation want to revive the indefinite strike without any further delay. Chairman and convenor of NJCA (NFIR & AIRF) are authorized to declare strike.

5.      ALL INDIA WOMEN’S TRADE UNION EDUCATION CAMP – 2018 OCTOBER 29TH & 30TH AT HARIDWAR
C-O-C, U.P. State is making all arrangements for the successful conducting of the Camp in consultation with C-O-C Uttarakhand. Hall of the Camp and accommodation for delegates are already booked. All affiliates and C-O-Cs are once again requested to ensure participation of lady delegates as per the quota already fixed. Please instruct the lady delegates to book their travel tickets immediately. Haridwar is an internationally renowned holy place and tourist Centre. There will be more rush of tourist and pilgrims during October. Hence tickets may be booked now itself. National Women Convention will also be conducted on the Second day of the Camp and new office bearers of Women’s Committee will be elected. C-O-C UP proposed to convene a seminar along with the Camp (Copy of the previous Circular is attached herewith).

6.      2018 SEPTEMBER 19TH – 50TH ANNIVERSARY OF 1968 SEPTEMBER 19TH STRIKE.
It is decided that the 50th anniversary of 1968 September 19th Strike may be organized at all Centres in a befitting manner by hoisting of flags in front of main offices, paying homage to martyrs of 1968 strike, conducting gate meetings/general body meetings, honouring those leaders who participated in the 1968 strike and victimized by Government.

7.      KERALA FLOOD HAVOC- DONATIONS TO CHIEF MINISTER’S FLOOD RELIEF FUND
Reports from affiliates and C-O-Cs show that Sincere efforts are being made by Confederation affiliates and C-O-Cs to collect maximum amount of donation towards Kerala Chief Minister’s Flood Relief Fund. The meeting decided to call upon al Central employees to donate at least one day salary towards Chief Minister’s Relief Fund.


All National Secretariat Members, Chief Executives of affiliated organisations and General Secretaries of C-O-Cs to take necessary action to convene their managing bodies to implement the above decisions.
