NJCA DECIDES TO OBSERVE "ALL INDIA DEMANDS DAY" ON 19th SEPTEMBER 2018

Dear Comrades,

NJCA has given a call to observe 19th September 2018, the 50th Anniversary day of 1968 strike of Central Govt. employees, as ALL INDIA DEMANDS DAY protesting against the betrayal of BJP - led NDA Government and demanding immediate settlement of the following three demands. NJCA has also resolved and informed the Cabinet Secretary its decision to revive the deferred indefinite strike of Central Govt employees, in case The Govt refuses to settle the demands.

Demands :-
1) Upward revision of Minimum Wage and Fitment Formula
2) Scrapping the New Contributory Pension Scheme.
3) Allow Option-1 as one of the Pension Fitment Formula.

Confederation National Secretariat calls upon all affiliated Organizations and State / District level C-O-Cs to observe "Demands Day" on 19th September 2018 (if possible, jointly with Railway & Defence Federations) through out the country by holding protest demonstrations and rallies at all centres and also in front of all offices.

LETTER ON PROBLEMS FACED BY CGHS BENEFICIERIES IN MUMBAI GIVEN TO ADDL.DIRECTOR, CGHS, MUMBAI.

Massive Dharna Programme was held infront of office of Addl. Director, CGHS under the banner of Confederation of Central govt. employees & Workers, Mumbai Unit, demanding improved CGHS facilities in the City of Mumbai on 30.8.2018.

            In the joint meeting of the Confederation of Central Govt. Employees & Workers, Mumbai and the Pensioners Association held on 13-08-2018, the following problems faced by the CGHS  beneficiaries came to the fore :

1.   It is a matter of great concern as all the available hospitals in Mumbai, empanelled under CGHS, are short of basic infrastructure with poor treatment facilities. However, the CGHS beneficiaries are forced to go to such Hospitals against their own wish in the absence of empanelment of important/multispeciality hospitals under CGHS in the city of Mumbai.  The rights of the patients to avail best available treatment in the hospitals of their choice are denied in the process, thereby violating their rights. It may be mentioned here that the Hon’ble Supreme Court in a recent judgment has said that the Govt. employees are entitled to have best medical facilities available. However, the CGHS authorities are taking hardly any efforts to empanel best hospitals avaialble in the Mumbai.

2.   In the meeting of the Sub-Committee (Medical) of Central Govt. employees Welfare Co-ordination Committee, Mumbai, thirteen major hospitals expressed their willingness to render their services to the CGHS but were skeptical about the complicated payment system. The CGHS has not acted on this report so far.


3.  As per our information, there are 32,951 cardholders and 1,22,639 beneficiaries among the serving officers and officials and 23,388 card holders and 47,890 beneficiaries of Pensioners  as on January, 2018. Therefore, even if we are to take only the serving employees and Officers, the approximate amount of subscription calculated on the basis of the minimum amount of Rs.350/-, comes to 1.15 crore per month  and Rs. 13.84 crores annually from the City of Mumbai.  If we are to go by the exact figure including the amount collected from the retiring employees/officers this will increase further and the per annum subscription coming in to the coffers of the CGHS will be a staggering amount. However, inspite of collecting such a huge amount from the stake holders, the services provided by the CGHS is poor in the City of Mumbai. No other city in the whole country will have such abysmal situation as far as the functioning of the CGHS is concerned. It is pertinent to mention here that in a city like Hyderabad the beneficiaries are provided with 51 reputed hospitals whereas a city like Mumbai with large number of Central Govt. offices  is given a raw deal as far as the medical facility is concerned. The CGHS authorities always find it convenient to take shelter under the argument of a    
legal petition filed by a Pensioner who is  not following up the case presently as  he is not in the best of health. The settlement of this legal hurdle will again burden the CGHS to put in concerted efforts, therefore it was never their priority. This whole mismanagement of the CGHS in the City of Mumbai is a fit case to be taken to the Consumer Redressal forum as the consumer rights of the beneficiaries are violated by the CGHS authorities without providing the service for which they are compulsorily made to pay.

            We have had various rounds of talks with the CGHS authorities at various levels but so far the problems have turned from bad to worse.  In our joint meeting held on 13-08-2018 the members of the Confederation consisting of various organizations of Central govt. Employees and the members of Pensioners Association have expressed their strongest displeasure towards the CGHS authorities functioning at Mumbai in this regard.  Therefore, it has been decided to take to agitational path against the callous attitude of the CGHS authorities by staging a One Day Dharna program on 30th August from 11 a.m. to 3 p.m  in front of the CGHS office at Old CGO Building, Ground floor , Mumbai -400020. 





            If the issues are not resolved, the Confederation and the Pensioners Association will be constrained to chalk-out further course of action in the  days to come.

10 POINT CHARTER OF DEMANDS

               1.  Scrap New Contributory Pension Scheme. Restore old defined benefit Pension                            Scheme to all employees.
2.   Settle 7th CPC related issues including increase in Minimum Pay and fitment formula, HRA arrears from 01-01-2016, MACP Bench Mark,  promotional heirarchy and date of effect from 01-01-2006, Option-I for pensioners and anomalies arising out of implementation of 7th CPC recommendations.
3.   Fill up all vacant posts. Reintroduce Regional Recruitment for Group B & C posts. Withdraw orders for abolishing posts lying vacant for more than five years.  Revive all posts abolished during 2001 to 2008 under Annual Direct Recruitment  plan as per  May 2001 orders of former NDA Government.
4.   (a) Regularisatin of Gramin Dak Sevaks and grant of Civil Servant status. Implement remaining positive recommendations of Kamalesh Chandra committee report.
     (b) Regularise all casual and contract workers including those appointed on or after 01-09-             1993.
5.   Ensure equal pay for equal work for all. Remove disparity in pay scales between            Central Secretariat Staff and similarly placed staff working in field units of various      departments.
6.   Stop closure of Govt. establishments and outsourcing. Withdraw closure orders of Govt. of India Presses. Stop proposed move to close down salt department. Stop FDI and privatisation of Railways and Defence department.
7.   Implement 7th CPC wage revision and pension revision of Autonomous body    employees and pensioners. Grant Bonus to Autonomous body employees  pending from 2016-17 onwards.
8.   Remove 5% condition imposed on compassionate appointment.
9.   Grant five time bound promotions to all Group B&C employees. Complete Cadre                         Reviews in all departments within a time-frame.
10. (a)   Stop attack on trade union rights. Ensure prompt functioning of various negotiating                forums under the JCM scheme at all levels.
      (b)   Withdraw the draconian FR-56(j) and Rule 48 of CCS Pension Rules 1972.

An appeal for financial help to overcome an horrible situation in Kerala

The unprecedented rains in Kerala, which lashed the coastal state for the past one month or more, caused havoc of horrible nature. The rains caused landslides in the hilly regions of the state, where the density of population is as high as in the Planes. Almost all dams numbering about 40 and reservoirs came to the brink of danger mark, not happened any time in the recent history. The authorities were left with no alternative but open the shutters of the reservoirs which created another terrible situation not only in the hills but over the Planes too. Every river in the state began to overflow creating horrendous disaster. Kerala is full of rivers, rivulets, canals and blackwaters besides innumerable water bodies. The water that gushed through the outlets drew houses and other buildings into it. The relief operations of the State Government ably assisted by all political parties, their workers and other voluntary organizations did an exemplary job in rendering help to the affected people. Despite this all-out efforts hundreds of people lost their life and thousands lost their lifelong savings and properties. Red alert was in operation in all the fourteen districts of the State indicating the extent of havoc created by the nature’s fury. Most of the villages, towns and cities have become islands, surrounded by water and cut off from each other. Rail and road traffic were severely affected. The air traffic at Cochin Air Port came to a standstill. The low-lying areas, the river bank hamlets all are submerged under water. Electric installations pump houses roads and many buildings have been destroyed. The loss estimated to be at Rs. 20,000 crores. More than 400 pepoles died and more than 10 lakh people directly affected in this unprecended calamity. Army, Paramilitary forces, Navy and Airforce personnel, Coast Guards, National Disaster Relief Forces have all been involved in the rescue operations, besides the State police and local people. The state is facing a war-like situation needing help from all.

Scrap Contributory Pension Scheme (Known as New Pension Scheme - NPS) and restore Defined Benefit Pension Scheme under CCS (Pension) Rules 1972 to all Central Government Employees, joined in service on or after 01-01-2004.

          Contributory Pension Scheme (called as New Pension Scheme - NPS) was introduced through an executive order with effect from 01-01-2004 for all Central Government employees who joined service on or after 01-01-2004.  Subsequently Pension Fund Regulatory and Development Authority Act (PFRDA) was enacted to make it statutory. As per the NPS 10% Pay plus DA will be recovered from the employee each month and an equal amount will be contributed by Government.  The amount goes to the Pension Fund and from there to share market.  As per the PFRDA Act - “There shall not be any implicit or explicit assurance of benefit except market based guarantee mechanism to be purchased by the subscribers”.  Thus it can be seen that the contribution in the Pension Fund is fully dependent on the vagaries of share market.  There is no guarantee whether pension will be received at the age of 60 years and even if received what will be the amount of pension.  Now, many employees who entered service on or after 01-01-2004 has started retiring from service after completing 12 to 13 years service.  They receive a megre amount of 900 to 1700 as monthly pension, whereas as per the old pension scheme an employee with minimum 10 years service is eligible for 50% of last pay drawn as monthly pension, subject to a minimum of Rs.9,000/- per month, that too without giving any contribution to the pension fund.  With meager amount of Rs.900 to 1700 how a pensioner and his family can survive?          It is this bitter reality that compels the employees to demand scraping of NPS and restoration of the old Pension Scheme for all those employees who entered service on or after 01-01-2004.

                Sub : 10-point charter of demand vis-à-vis agitation programme

At the outset, we, on behalf of Central JCA, convey our sincere thanks and revolutionary greetings to all the members of ITGOA and ITEF for successfully carrying out the agitation programme under the banner of JCA as well as unstinted support to the Central JCA during these period. The Central JCA was called for a meeting by the Member (Admin) on 30-07-2018 and all the issues mentioned in our 10-point charter of demand were thread barely discussed. A gist of such discussion was already circulated; however, a copy of the same is enclosed for ready reference. In the meeting, the Member (Admin) assured to take action immediately and also directed the concerned authorities for initiating action immediately. In the meeting the Member (Admin) also appealed to the JCA for withdrawal of the on-going agitation. The Central JCA leadership also met the Chairman in presence of Member (Admin) and Member (A&J) today i.e. 31-07-2018. In the meeting, the Chairman as well as Members present assured to take required actions in respect of all the issues contained in our 10-point charter of demands as assured by the Member (Admin) in the meeting held on 30.07.2018. In view of the discussion held with the Member (Admin) on 30.07.2018 and with the Chairman today and considering the actions initiated, the Central JCA decided to give some window to the CBDT for taking necessary steps, as assured in the meeting. Accordingly, it is decided to suspend ongoing (not withdrawn) agitational programme till 17-08-2018. In case, no positive & effective steps as assured by the Chairman and the Member (Admn.) are taken by the Board within this period, the agitation programme will immediately commence. 2 | P a g e The above decision of suspension of agitation has already been communicated to the Chairman vide Central JCA’s letter dated 31-07-2018. We have also informed the Chairman vide JCA’s letter dated 31-07-2018 to direct the authorities below not to create any undue pressure and panic on our members for immediate submission of pending reports and allow reasonable time for submission (at least upto 10th August). We will also request the members of JCA to be vigilant and be ready for reviving the agitation if the commitment/assurances given by the Member (Admin) as well as Chairman, CBDT remained unfulfilled by 17.08.2018.
